Another Day In Asheville

Asheville is the closest North Carolina comes to San Francisco - the mountains, the culture, but that is where the similarities end. There is a very belligerent and ultra sanctimonious right wing in Asheville. Years ago, there was a rally to pray to boot out "paganism." Last year my wife and I happened visited town while a horrific anti-gay protest was in progress sponsored by local area "churches." This past week, Asheville saw one of it's own arrested for holding a protest sign.
On Wednesday August 15, I was standing alone with my sign for about 10 minutes, when I was approached by Police Officer Russell Crisp. He asked me how long I was planning to stay there and I told him just a few more minutes because I had to go to work at 8:00. He asked for my ID and I obliged. I asked him if I was doing something wrong, and he said that his Sergeant was on the way and he was going to wait for him. SO, I went back to my sign holding over the interstate.
A few minutes later Sergeant Randy Riddle showed up with a paper in his hand. He spoke briefly to Crisp, then walked over to me and told me to put down my sign, put my hands behind my back, and that I was under arrest! I was shocked and almost thought he was joking until he told me again to put down the sign and put my hands behind me and I was under arrest. So I peacefully agreed and he cuffed me. I asked him why I was being arrested, he told me I was in violation County Ordinance 16-2, (the print out in his hand that he didn't bother to read to me or show me.) He told me I was obstructing the sidewalk. I told him I was not and that officer Crisp had witnessed a guy walk by me moments before.
Riddle yelled at me, "You were obstructing the sidewalk!" and "I'm sick of this shit!" then he said, "Here's your 15 minutes of fame buddy!" I looked back to see his name plate and he said in a mean condescending tone, "Yea, that's 'Sergeant Riddle' get it right!" He then put me in Officer Crisp's police car. Riddle took my sign with him and I was taken downtown and booked by Crisp. I was never read my Miranda rights.
Someone needs to call Mayor Bellamy and ask her when Civil Rights will be reestablished in Asheville? Or does she intend to allow the gestapo to operate freely in his city?

Oh, I so wrote my old-hometown mayor
Honorable Madam Mayor:
I am a veteran and I vote. Many of my family still live in Asheville and they vote. We never miss an election day. Ever. You see, we take the Constitution of the United States and its Bill of Rights quite seriously.
I grew up in Asheville but now live in Greensboro. Yesterday I was shocked, saddened and dismayed beyond amazement at the patently unAmerican, even fascist actions of Officers Crisp and Riddle in the case of their harassment of a man holding a protest sign. You see, though I don't currently live in Asheville, my ear is still to the ground.
Sadly, it was through a national medium that I learned of this incident. My family have been strongly Democratic, staunch defenders of the Constitution and proudly military for generations. I have been on the phone since yesterday, calling every family member back home. We agree absolutely: Immaterial of whether we agree with Mr Phillips' sentiments, we have and will continue proudly to defend his First Amendment right to have his say. Further research into this incident revealed to us that, by all accounts, Mr Phillips broke no laws and governed himself within the local statues for protest.
Across the nation (even across the state), this is being viewed as an open and shut case: Mr Phillips' rights were clearly violated by a pair of cowboy vigilantes whose lack of understanding and respect for the laws of these United States puts them at odds with the badge they wear. Their actions are clearly at odds with the Constitution of the United States. There is no legal question here, no fine points, no grey areas, end of story -- except for the matter of redress.
Officers Crisp and Riddle, in their unAmerican, even storm-trooper zeal are clearly out of line. I respectfully suggest that they review their civics courses at a minimum. It is also painfully obvious that they should hand in their badges. This is America -- not nazi Germany. If they cannot abide within American standards of law, then it is clear that they have no business in law enforcement, QED.
The very thing that makes this nation great is her Bill of Rights. In fact, that is the one and singular thing that makes America "America"; not a flag, not a cross, and certainly not intolerance and the trampling of civil and Constitutional rights. I served this country -- twice -- to defend that very Bill of Rights. I expect our elected officials, who swear the same oath to uphold the Constitution, to do no less. Period.
The stench of this incident has gone nationwide. It is an embarrassment for me to admit that I was born and raised in Asheville. I trust that you will seek to put Asheville back on a footing based upon the Constitution of the United States, and redress this outrage and embarrassment.
If not, I hope Mr Phillips sues the living shirt, socks, pants and shoes off the city.

I got an email from the Chief of Police and he says...
... more or less he was cuffed, arrested, searched, booked, interrogated and had his tattoos photographed and cataloged for jaywalking - the Chief describes it as crossing the street thus obstructing traffic.

Asheville does not have stormtroopers roaming the streets in search of hippies.
We have an excellent police force by and large, and it's not fair to reduce them to this imaginary level. The policeman who cited the "Impeach" protestor (Jonas Phillips - his blog is here) was totally out of line. The officer involved with the Kuhns acted entirely irresponsibly.
In the Kuhns case, all charges were dropped. Sheriff Van Duncan is going to take questions from callers on Asheville's most popular talk radio show "Take A Stand" with Matt Mittan.
Anyway, what I'm saying is that everything hasn't gone all to hell out here in Asheville. It's two wrongheaded cops with a good police force to bust their chops for harassing political protestors.
Here's hoping that the good cops don't see your cartoon.

So why aren't the Triad, Triangle and Charlotte having the issues of policing protesters that Asheville is having? I have posted here and elsewhere when I was at the 3-11-07 anti-Gay rally, the police only patrolled the counter-protesters (hint: they are Gay) and never strolled through the Gay bashing "Christian" section. Why were the Gays the only ones video taped by the cops and not the ones with the stage bashing Gays with all the moral fortitude of Adolf Hitler?
I am unsure if you were at that rally, but my wife and I were and it was right out of the Hitler Youth playbook - a totally disgusting sight. The pure unadulterated filth that came out of the mouths of those so-called Christian preachers was astonishing, but they were not the ones being filmed. I was... me and my black wife and couple hundred homosexuals and their supporters.
I am sure Asheville has good cops, but it seems to me with all the other stories in the news, on the blogs - and all the other stupid things the town cops are doing, specifically with protests, there is a deep-seated problem with that town's police force.
I am sure there are some good Republicans, but don't expect me to back down from speaking my mind about Bush. What if those "good Republicans" saw one of my Bush strips? I hope they do.
Someone needs to hose them down with some reality.
The good cops are having their jobs made more difficult by the likes of Riddle, not me. I am not going to lounge about when I see the rights of others stripped away.

Yes, I was at that rally. I wrote about the incident extensively.
Here in Asheville we've had a lot of protestor/police run-ins over the years. Sometimes they go very well. You won't be hearing about those.
I'm saying there's not a systemic problem in the force. There are a few numbnuts whose temperaments would be better suited for gym coach or driver's ed instructor, but our new Sheriff, Van Duncan, is a good man and a good Democrat. Our Police Chief has made great strides in updating the force and prioritizing.
You say whatever you want, dude, I'm not defending the cops who behaved badly. I'm saying you're misreading the situation and making yourself look offensive for its own sake.

I see both your and SB's views as worthy of consideration.
If Asheville is serious about fixing this problem the first thing they can do is fire Riddle...and make sure he never works in law enforcement again. If they don't do that then SB will be proven on target. It's that simple....you violate someone's constitutional rights by arresting and abusing them verbally...you're fired! Special responsibility comes with wearing a badge. (We also need to pay properly...but that's not under our control.)
