It's unanimous!

The Supreme Court unanimously smacks down Duke Energy for trying to end-run the Clean Air Act. This case was argued by lawyers from the Southern Environmental Law Center, who recently spoke at the political salon hosted by my wonderful wife here in Chapel Hill!

This is very good news.

The U.S. Supreme Court gave a boost Monday to a federal clean air initiative aimed at forcing utilities to install pollution control equipment on aging coal-fired power plants. In a unanimous decision, the justices ruled against Duke Energy Corp. in a lawsuit brought by the Clinton administration, part of a massive enforcement effort targeting more than a dozen utilities.

The justices ruled that the 4th U.S. Circuit Court of Appeals overstepped its authority by implicitly invalidating Environmental Protection Agency regulations in a way that favored Duke. The case now returns to the lower courts. The appeals court's decision "seems to us too far a stretch," Justice David Souter wrote.

The enforcement program is aimed at reducing power plant emissions of nitrogen oxide and sulfur dioxide that contribute to smog and acid rain. Sulfur dioxide is the leading cause of acid rain. The utility industry has long resisted installing costly pollution controls under the program called New Source Review. It waged vigorous campaigns against the program starting in the 1980s and more recently by battling it out with regulators when sued in federal courts.

There appear to be multiple decisions . . . curiouser and curiouser.

According to CNN

The decision against Duke Power is unanimous.

In another decision, the Court ruled against the Bush admin 5-4 on greenhouse gases.

Things are looking up for the earth. [She says hopefully]

I'm afraid both decisions are still

baby steps. In the Duke case:

The justices ruled that the 4th U.S. Circuit Court of Appeals in Richmond, Virginia, overstepped its authority by implicitly invalidating Environmental Protection Agency regulations in a way that favored Duke. The case now returns to the lower courts.

In the greenhouse gas case, by a 5-4 margin, the court

ordered EPA to re-evaluate its contention it has the discretion not to regulate tailpipe emissions. The court said the agency has so far provided a "laundry list" of reasons that include foreign policy considerations.

So each case looks to me like progress, but not yet victory.

And what is most interesting... the Duke Power case was brought

by the CLINTON administration.
