My former state representitive is still in the news

The Wake County school system stands to get less than half of the amount it expected from land that disgraced former House Speaker Jim Black gave to pay part of the fine for his state corruption conviction.

By the way, could someone explain to me why Wake County schools get the money?

From the General Statutes:

§ 115C‑452. Fines and forfeitures.

The clear proceeds of all penalties and forfeitures and of all fines collected in the General Court of Justice in each county shall be remitted by the clerk of the superior court to the county finance officer, who shall forthwith determine what portion of the total is due to each local school administrative unit in the county and remit the appropriate portion of the amount to the finance officer of each local school administrative unit. Fines and forfeitures shall be apportioned according to the projected average daily membership of each local school administrative unit as determined by and certified to the local school administrative units and the board of county commissioners by the State Board of Education pursuant to G.S. 115C‑430. (1975, c. 437, s. 1; 1981, c. 423, s. 1.)

I'm assuming Black's case was adjudicated in Wake County, which is why the fine went there.

Wake County case

Gray, State Board of Elections cases are referred to the Wake County District Attorney and tried in Wake County court, so the proceeds go to the local school board. The Wake Board should have sold the land when they got it but the newly elected Republicans were too busy playing politics. Now it's a bit like a kid complaining that a free ice-cream cone has melted because he waited to long to eat it.

The answer is....

Wake County gets it because that's the way the Raleigh good old boys set up the program to benefit Wake County over other county schools systems. This is an example of why Charlotte has no use for Raleigh. They get the gold mine and we get the shaft. It should have been prosecuted in Charlotte. Black was a Mecklenburg County Representative.

§ 7A‑61. Duties of district attorney.

The district attorney shall prepare the trial dockets, prosecute in a timely manner in the name of the State all criminal actions and infractions requiring prosecution in the superior and district courts of his prosecutorial district, advise the officers of justice in his district, and perform such duties related to appeals to the Appellate Division from his district as the Attorney General may require. Effective January 1, 1971, the district attorney shall also represent the State in juvenile cases in which the juvenile is represented by an attorney. Each district attorney shall devote his full time to the duties of his office and shall not engage in the private practice of law.
