Kissell v Hayes, NC-08 - Waiting......Waiting...... (UPDATE)

It was a long cold rainy day and worth every minute of it. There are so many people who have worked so very, very hard for this day. Win or not, this has been an amazing experience and one I will not forget for the rest of my life.

Larry is up in Mecklenburg County and I'm checking the different counties. I'll post some stories from today in a bit. I need to check for some numbers.

In checking individual counties I can only find Stanly County results which typically goes for Hayes with 70% of the vote. He's at 62% with 24 of 28 precincts reporting.

Mecklenburg is only showing early voting numbers still.

Many of the counties do not have their own web sites, so it's a bit tough to find them all.

Typically, minority and smaller town boxes come in last and those should favor Larry. Don't get discouraged yet.

I'm having a hard time logging in. I will keep trying, but don't know how much patience I'll have.

Anson has reported in with 3370 for Kissell and 2119 for Hayes.

Stanly is reporting 26 of 28 precincts in with 6033 votes for Larry and 9452 for Hayes. It is a narrower margin that Hayes has enjoyed in the past in Stanly County.

Cumberland, Hoke and Scotland - can't find online results for them.

We're still waiting for a portion of Mecklenburg, but I don't know if the margin will be enough to close. Most of the smaller counties are not available online. I know that Union, Cabarrus and Stanly have all reported in and they are the Republican strongholds.

Wow. This is close. I can happily report that Robin Hayes will not win one - NOT ONE precinct in Mecklenburg County. I'm not sure the number of votes is there to make up for Stanly and Cabarrus. The precinct that I worked - 205 - is the only precinct that Hayes has won for the two cycles Meck has been part of the district. Larry Kissell won that precinct by a handful of votes. It makes the aches and chills worth it.

More Kissell votes have been found. The difference between the two has narrowed to 346 votes. The totals at SBOE now stand at 61,168 for Hayes and 60,822 for Kissell. Let's count those provisionals!

Larry has renewed my excitement about politics. I get excited about policy, but almost never about candidates. Sure, I get a little misty-eyed thinking of the Big Dog's day, and I was a little high on Gore on my way out of An Inconvenient Truth, the Larry is the only candidate who has reduced me to sounding like a giddy kiddy.

We may have Robin Hayes to kick around

Meck is 3/4 in, and has been going about 2:1 for Larry. Cumberland county is about 3/5 in, and has been going about 2:1 for Hayes. The other counties are all in. I don't know much about the relative populations, but there would have to be a hell of a lot of votes coming in from Meck in the end count to get Larry over the hump. I'd really like to be wrong about this.

I misread the Cumberland numbers before

Hayes' margin there is much lower. Cumberland's nearly all in, and Larry needs to find 2,200 more votes than Hayes in that last 25% of Meck.

The state board can order a recount whenever they want

In addition:

Mandatory Recounts for Ballot Items Within the Jurisdiction of the State Board of Elections. – In a ballot item within the jurisdiction of the State Board of Elections, a candidate shall have the right to demand a recount of the votes if the difference between the votes for that candidate and the votes for a prevailing candidate are not more than the following:

  • (1) For a nonstatewide ballot item, one percent (1%) of the total votes cast in the ballot item, or in the case of a multiseat ballot item, one percent (1%) of the votes cast for those two candidates.
  • (2) For a statewide ballot item, one‑half of one percent (0.5%) of the votes cast in the ballot item, or 10,000 votes, whichever is less.

But before I go, I'd just like to say a few things:

You guys and gals are the most awesome friends in the world. I'm honored to be associated with all of you and I'm totally inspired by your energy and commitment.

The mountain contingent has been unbelievable. My hats off to each of you for never letting up for one damn second. Up Chuck is already dwindling to nothing more than a bad memory.

In NC-8, I'm optimistic that Larry will come out on top. Four hundred votes is a rounding error and Mr. Kissell has karma on his side. He is the right man for the job and you all have done everything humanly possible to help him across the finish line.

Who decides when and if

provisionals are counted? Does that come before recounts? I'm all questions and no answers tonight.

FAQ on provisionals

1. Who determines whether or not a provisional ballot is valid?
State law provides that the County Boards of Elections determine the eligibility of
provisional ballots in their jurisdictions. Each county board is made of three members, a
Chairman, Secretary, and Member. There is only one municipality with an Election Board.
They determine the validity of provisional ballots in their municipal election.
2. What is the time frame for counting provisional ballots?
State law sets the deadline for counting provisional ballots to be the County Board Canvass.
3. What is the process for determining the eligibility of a provisional ballot?
Based upon research of documentation of voter information at the County Elections Office,
the County Board of Elections approves or denies a provisional ballot.
4. Who can observe the process?
The public can observe this process as long as they do not interfere with the ongoing
operations of the County Board Office.
5. Is a provisional ballot counted if it is cast in the wrong precinct?
An otherwise valid provisional ballot cast in the wrong precinct, but the right county, will be
counted in the races for which the voter is eligible to vote.
6. What information must voters provide on the provisional ballot?
The voter provides their name, address, birth date, signature, and party affiliation, the same
data that is required to register to vote, on the provisional ballot envelope.
7. May a voter remedy a provisional ballot that may be rejected?
To have his ballot counted, the voter who cast a deficient provisional ballot must appear in

It looks like the counties have their time to count them. Do not expect anything tonight.

I updated this post. They found some votes somewhere. SBOE just updated about 40 minutes ago and the total is Hayes 61,168 to Kissell 60,822 for a difference of 346.

You will be happy to know, SD, that there were Kissell stickers on the front desk at the NCDP State HQ last night at the Victory Party. (Of course, I put one on!)

I talked with several Edwards supporters about how Edwards campaigned for Kissell and said, "Larry is not just the son of a millworker, he IS a millworker!" lol. Everyone was rooting for him.

So is it possible for us to get a list of who filed provisional ballots, and where? Can we not take the next step and ask folks to go down and make sure their provisional ballots are counted? I'm not content with just sitting around and waiting. I need something to do.

Just received a press release from the NCDP

They have their lawyers working on making sure every vote is counted. I'm not sure there's anything we can do. It's tough to have to sit and wait.

Any updates on the provisional ballots? Has anything been counted yet? What's the deadline for getting it done? I can't stand this waiting and not knowing.

NC-08 Count Status

Raleigh 10.30am

I just left the State Board of Elections where the status was explained to me.

Each county Board of Elections is currently auditing the count by comparing the tapes with the reported counts. In some cases a reported precinct number was incorrectly added to the total causing it to be counted twice. The SBOE (unofficial) numbers are being updated as they are being re-reported by the Counties. The SBOE will not know about provisional ballots officially until November 17th, canvass day.

Each County Board is in the process of evaluating provisional ballots which will be added to the count by canvass day, Nov 17th, but on no fixed schedule. To learn if all the provisional ballots have been counted before then, each County Board will have to be contacted. A request to a County Board could be made for notification of when all the provisionals have been evaluated and counted in that county.
