Lawsuit filed against McCrory

RALEIGH – Yesterday morning, May 24, 2012, North Carolina Citizens for Progress and the Democratic Governors Association (DGA) filed a Complaint for Declaratory Judgment in Wake County Superior Court against McCrory and The Pat McCrory Committee. This Complaint has the effect of turning the tables on Pat McCrory and calling his legal bluff.

For days, Pat McCrory has been threatening legal action and making false claims regarding N.C. Citizens for Progress and the DGA. Yet despite his numerous pronouncements and news releases claiming a defamation lawsuit had been filed, the fact is there was no lawsuit filed.

We proactively filed this complaint because we are confident the facts and the law are on our side and we refuse to let McCrory's threats intimidate us or media outlets. Unlike his one sentence “complaint”—which was far shorter than his many press releases about it—our real lawsuit will force McCrory and his campaign to actually back up in a court of law the specious claims they have been making in the press all week.

To prove McCrory's claims are false, we will move forward with discovery and plan to depose McCrory and his associates before November 2012, to answer questions about his business relationships and his contact with public officials. We believe these sworn depositions will help shed considerable light on McCrory's refusal to disclose who is paying him and what they are paying him to do.

I wonder how much time lawyers at MVA are spending talking about this for McCrory. I wonder how much of that time will be reported as an in-kind campaign contribution?
