Lots of hemming and hawing, but no finger poking and everyone left the meeting understanding the elections process alot better.

RALEIGH --State Auditor Les Merritt defended his review of North Carolina's voter rolls Tuesday, saying it is not motivated by partisan politics.

"I don't consider this to be a partisan issue, and I don't want it to be perceived that way," Merritt, a Republican, told a state Senate elections committee.

"Sometimes there can be explanations for things, or for everything. That's why we have the process," Merritt said.

...N.C. Democratic Party chair Jerry Meek pointed to reports of politicization of the GOP-led U.S. Justice Department, which has put an increased focus on reports of voter fraud.

"Either Les Merritt is incompetent, lacking even a basic understanding of election law, or he's using his position as State Auditor to pursue the partisan agenda of the national Republican Party," Meek said in a news release. "Either way, voters should be worried."

Merritt gave no timetable for when his office might release a final report.

A bill to allow voters to register three days before an election is back.

Last week, Senate leaders pulled the bill — for the third time — after state Auditor Les Merritt told them that a preliminary investigation showed problems with the state voter rolls.
...But Sen. Dan Clodfelter said that Merritt's report was incomplete and should not affect the bill. He also cautioned against interfering with the legislative process without good reason.

"If you're going to blow the whistle on something, you need to know whether there's a problem or not," he said.

BUT AGAIN, EXACTLY WHAT IS THE DEPARTMENT OF JUSTICE (DOJ) UP TO? That remains to be answered.

Send this to your Congressman and ask them to add this to the inquiries in Washington about the politicization of our Department of Justice Voting Rights Division.

The DOJ mandate

in the area of voting rights has always been focused on ensuring that no individual or group of individuals is prevented from voting. The only reason they would/should get involved with purges is if the purging authority is too aggressive. From their website:

The National Voter Registration Act, also known as the NVRA or the Motor Voter Act, is another significant pieces of voting rights legislation. The NVRA facilitates voter registration for federal elections by allowing voters to register by mail, when they obtain driver's licenses, or when they obtain services from various government agencies, and it permits voter purges only under very controlled conditions. It also helps ensure that eligible voters are not removed from the voting rolls and that people who move in the same registrar's district retain their eligibility to vote even if they have not re-registered at their new location.

The Constitution and subsequent amendments that deal with voting issues are very specific, and all have one thing in common: the only goal of Federal involvement in the elections process is to guarantee voting rights are not abridged.

To vigorously pursue the removal of names from voting rolls is not only outside the DOJ's civil rights mandate, it is also veeery close to being outside of the U.S. Constitution.

But the NC State Board of Elections debunked Merritt's "preliminary research".

How many voter reg records did they reference in order to arrive at the 25,000 number for incorrect DL#s?

The Bartlett letter actually challenged the numbers they claimed to have looked at. Merritt said 50% and he said 4.5 million voters. Except we have 5.5 million total registered voters.

So no one has any idea what he is talking about.

I'd have to say I'm surprised they were able to find only 25,000 bad DL#s.

I mean, I've worked more voter reg drives than I care to admit, and the amount of incorrect info people put down on those forms is just astounding. Factoring for sloppy handwriting alone would get you 25,000.

At issue is WHEN was the state required by law to check the Drivers license or the social security numbers against govt databases. That's where Merritt goes wrong, he is finding voters who have been in the system before NC was required to verify that info.

Now, what happens today when voters register to vote in North Carolina?

We have a problem in NC, called the "No Match, No Vote" rule.

In North Carolina, when a person registers to vote, they must either provide a drivers license number, a social security number, or some other form of identification.
A positive match between the number given and either the drivers' license or social security database must occur before a person's name is placed into the voter registration database.

Justin Levitt , an attorney at the Brennan Center for Justice advises that: "North Carolina's procedures * as we understand them * will predictably keep eligible citizens from voting, in a way that is contrary to federal law ... and that is why we remain concerned."

Our goal is to seek a change in this rule either administratively or legislatively.

When North Carolina's Voter Registration checks the Dept. of Motor Vehicles’ and the Social Security Departments’ Database for a “match”, some eligible voters will not be registered:
• Matches of Drivers license numbers (most commonly used) had a 98.25 % valid rate of return,
• Matches against the Social Security Database had only about an 80 % valid rate of return.

Matches can fail because of clerical errors, identical 4 digits of SS numbers between multiple people, applicants providing driver license numbers from a previous state because they don't yet have a new driver license, or an elections clerk may make an honest mistake in data entry for example. None of these mistakes mean that the applicant is ineligible to vote, but any of them may keep eligible citizens from the polls because of North Carolina’s practices. The registrant who does not provide a drivers license or social security number will not be subjected to the matching, but will be assigned a unique identifier and will be registered. This voter will be required to show some sort of identification the first time they vote. See the enclosed North Carolina Voter Registration Form.
