Federal judge expels Klan leader after comments in N.C. court
RALEIGH
A federal judge expelled a self-proclaimed Ku Klux Klan leader from his courtroom after the man ranted about court procedures during a motions hearing.
"Take him out of here," U.S. District Court Judge Terrence Boyle said Wednesday after Charles Robert Barefoot Jr. commented on the court's handling of his case.
Barefoot was arrested in 2002 after his home near Benson was raided and investigators found equipment to make bombs. He and six others, including his son and wife, were charged by federal prosecutors last year with conspiring to blow up the Johnston County courthouse by trafficking in stolen weapons.
Barefoot and four others also were charged in 2004 by state prosecutors with murder in the death of Lawrence Arthur Pettit of Jacksonville. Pettit's decomposed body was found in 2003 in a Sampson County field.
Barefoot has said he was the leader of the Nation's Knights of the Ku Klux Klan.
Before Barefoot was taken out of the courtroom, his lawyer had told Boyle that Barefoot hadn't had a competency hearing and that a psychiatrist said Barefoot had a delusional disorder.
Boyle delayed the motions hearing and sent Barefoot for psychological testing. He then allowed Barefoot to speak.
"I want to get on with this trial," Barefoot said. "I'm fed up with everybody stalling everything. I'm competent to stand on trial right here."
Boyle explained court rules to Barefoot, then said: "That's all gibberish, and that doesn't make any sense. That kooky stuff you are doing right now is almost proof positive that you are not competent."
Barefoot didn't answer before being taken away.
Judge Boyle himself was rule incompetent by the United States Senate 4 times after being turn down to serve on the Supreme Appeals Court because of his past racist views over the years while a State Judge and a Federal Judge. Republican Judge Boyle was chosen to be on the Supreme Appeals Court by Bush 1 and King George Bush the 2nd.
