When you're running for governor in the Party of Greed and you're not a multimillionaire like Bill Graham and Fred Smith, it's gotta be rough. Which might explain why Judge Bob Orr is having such a hard time cutting the strings that connect him to Art Pope. After years of toiling in the Pope's employ, Orr appears reluctant to bid the Puppetmaster farewell and strike out on his own.

A vocal critic of incentives used to attract businesses is preparing to sue because of tax breaks worth millions that the state recently promised Google. Bob Orr, executive director of the N.C. Institute for Constitutional Law in Raleigh, said Monday that the group's directors have authorized the institute to "move forward in its research and preparation of a legal challenge."

Orr, who is running for governor and plans to resign from the institute this month, said the suit will challenge the constitutionality of the exemption. He said the measure is illegal because it gave special treatment to one company, "which would seem to run counter to the fact that there be uniformity in the tax law." The suit could be filed by month's end, he said. Officials with the state Department of Commerce and attorney general's office declined to comment.

In case you missed it, Judge Orr says he doesn't have time to run Pope's "institute" and still campaign for governor. But now he's launching what will be one of the highest-profile lawsuits in his tenure at the Puppetshow? It looks to me like Orr is positioning himself perfectly to be a consultant to the "institute" in this complicated case. That means he'll still be on the Puppetmaster's payroll, with one big change: he'll no longer be subject to the disclosure requirements of a non-profit organization. Art Pope can pay Bob Orr as much as he wants, with all transactions completely protected by attorney-client privilege.

Sweet deal, heh? Quit your cushy job, get paid even more to consult with the guy who replaces you, and still get the Puppetmaster to steamroll your campaign!

Would this kind of sweetheart deal be illegal? I don't think so. Is this what's actually happening behind the scenes? We have no way of knowing.

I just hope the so-called watchdogs in the mainstream media start asking some hard questions.

990 changes

If I'm interpreting the new Form 990 correctly, NFPs are now required to report any compensation paid to former officers and directors as well as current officers and directors (perhaps because of situations just like this?). I believe they also must list the five highest-paid independent contractors for professional services, including legal and consulting.

I think there's a threshold amount

but I might be wrong.

If there is, I figure each act of the Puppetshow can pay Orr $4999 just like Pope did with his electioneering mailers . . . and still slide under the radar. Of course, he could also get paid to work for Variety Wholesalers, in which case any amount could be proffered and accepted . . . all masked by attorney-client privilege.

I hope you're right, though. I'm sure one of our many lawyer lurkers will come to the rescue by email.
